Terms of Use

These Terms of Use ("Terms") govern your access to and use of Creator Backchannel, including our website, services, features, content, and community (collectively, the "Service"), operated by Creator Backchannel LLC ("Company," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Creator Backchannel.

1. About Creator Backchannel

Creator Backchannel is a private professional community where verified creators can exchange information and experiences relating to brands, agencies, professional contacts, creator partnerships, and the creator industry.

Information available through Creator Backchannel may be contributed by community members and may be incomplete, outdated, inaccurate, or based on individual experiences. Creator Backchannel LLC does not guarantee the accuracy, completeness, or currentness of community-submitted information.

2. Eligibility and Account Approval

You must be at least 18 years old to use Creator Backchannel.

Access may be limited to creators who satisfy our eligibility and verification requirements. We may approve, reject, suspend, or revoke access in our discretion, subject to applicable law.

You must provide accurate information during verification and may not impersonate another person or misrepresent your identity, creator account, audience, or professional qualifications.

You may not sell, transfer, share, or provide access to your account to another person.

3. Member Anonymity

Creator Backchannel is designed so that members participate under anonymous community identities.

Your real identity and verification information are not intended to be displayed to other members through ordinary use of the Service.

However, we do not guarantee absolute anonymity. We may disclose information when required by law, valid legal process, or as otherwise described in our Privacy Policy.

You may not attempt to identify, expose, dox, or publicly reveal the identity of another anonymous member.

4. User Contributions

Members may submit posts, comments, questions, answers, corrections, confirmations, and other information ("Contributions").

You retain ownership of content you submit, but you grant Creator Backchannel LLC a non-exclusive, worldwide, royalty-free, perpetual license to host, store, reproduce, display, organize, format, analyze, and otherwise use your Contributions as necessary to operate, improve, moderate, and provide the Service.

You represent that you have the right to submit your Contributions and that doing so does not violate any applicable law, contractual obligation, confidentiality obligation, intellectual property right, or right of another person.

5. Community Posting Rules

Creator Backchannel exists to facilitate useful professional intelligence—not harassment, doxxing, leaks, or knowingly false information.

You MAY:

  • Share truthful professional experiences with brands and agencies.
  • Share professional contact information that you are legally permitted to share.
  • Discuss publicly available professional roles and employment information.
  • Share which brands, agencies, or professional contacts you have worked with.
  • Share your own experiences with creator campaigns and partnerships.
  • Ask other creators for contacts, experiences, recommendations, or industry information.
  • Correct information you reasonably believe is outdated or inaccurate.
  • Share opinions, including negative opinions, based on your genuine experience.
  • Discuss compensation or commercial terms when you have the legal right to do so.

You MAY NOT:

  • Knowingly post false or misleading factual claims.
  • Fabricate experiences, contacts, campaigns, compensation, or relationships.
  • Post defamatory statements.
  • Post trade secrets or confidential business information you are not legally permitted to disclose.
  • Post information covered by an NDA or other confidentiality obligation when disclosure would violate that obligation.
  • Upload or reproduce confidential campaign briefs, contracts, internal documents, private emails, or other materials you do not have the right to distribute.
  • Post someone’s home address, personal phone number, personal email address, family information, financial information, government identification information, precise private location, or other sensitive personal information.
  • Dox or attempt to identify another anonymous Creator Backchannel member.
  • Harass, threaten, stalk, intimidate, or target another person.
  • Impersonate another creator, professional, brand, agency, or Creator Backchannel LLC representative.
  • Manipulate community validation, Cred, voting, confirmations, referrals, or other reputation systems.
  • Create multiple accounts to fabricate independent agreement or community consensus.
  • Use information obtained through hacking, deception, unauthorized access, theft, or other unlawful means.
  • Post spam, advertisements, scams, malware, or unrelated promotional material.

When in doubt: share what you know and experienced—not something you're prohibited from disclosing.

6. Professional Profiles and Community Intelligence

Creator Backchannel LLC may organize information relating to brands, agencies, professional contacts, and professional relationships. Some information may originate from community Contributions, publicly available information, or other lawful sources.

A profile, relationship, contact listing, community confirmation, or similar entry does not constitute a guarantee by Creator Backchannel LLC that the information is accurate or current. Where appropriate, Creator Backchannel LLC may display information such as when information was last reported, updated, or confirmed.

If you believe information about you or your organization is inaccurate, outdated, unlawful, or violates these Terms, you may request review at admin@creatorbackchannel.com.

7. Moderation

We may review, restrict, remove, edit, organize, label, or otherwise moderate Contributions when we reasonably believe doing so is necessary to operate the Service, enforce these Terms, protect users or third parties, comply with law, or maintain the usefulness and integrity of the community.

We are not obligated to monitor every Contribution and do not guarantee that objectionable, inaccurate, or unlawful material will never appear.

Users may report Contributions for review.

Repeated or serious violations may result in suspension or permanent removal from Creator Backchannel.

8. Cred and Community Rewards

Creator Backchannel LLC may award points, status, access, features, or other community benefits ("Cred") for eligible activity.

Unless explicitly stated otherwise:

  • Cred has no monetary value.
  • Cred cannot be redeemed for cash.
  • Cred cannot be transferred or sold.
  • Creator Backchannel LLC may modify Cred rules, balances, rewards, or eligibility.
  • Fraudulent or manipulative activity may result in Cred being removed.

Creator Backchannel LLC may offer additional features or access based on contribution levels in the future.

9. Acceptable Use of Creator Backchannel Information

Creator Backchannel is intended for individual professional use by authorized members.

You may not:

  • scrape or systematically extract the Service;
  • use bots or automated systems to collect Creator Backchannel content without permission;
  • create or maintain a competing database using Creator Backchannel information;
  • sell, license, publish, or commercially redistribute Creator Backchannel data;
  • provide non-members with systematic access to Creator Backchannel content;
  • circumvent access controls or security measures;
  • attempt unauthorized access to accounts, databases, systems, or infrastructure.

Individual members may use information they learn through Creator Backchannel for their own lawful professional purposes.

10. Independent Pricing and Competition

Members are independent market participants and must make their own independent decisions regarding rates, fees, bids, discounts, services, contract terms, and whether to accept or decline an opportunity.

You may not use the Service to enter into, solicit, facilitate, encourage, or enforce any agreement or coordinated practice among creators or other market participants concerning:

  • Minimum, maximum, recommended, or standard rates;
  • Current or future pricing, fees, bids, discounts, or other commercial terms;
  • Whether to accept or reject work from a particular brand, agency, or other party;
  • The allocation of customers, brands, agencies, territories, opportunities, or markets; or
  • Any collective refusal to deal or other coordinated restriction on competition.

Creator Backchannel LLC may permit members to share truthful information about their individual past compensation or offers they personally received when they have the legal right to disclose that information. Such information is provided for general professional awareness and must not be used to reach or facilitate an agreement about present or future pricing or commercial conduct. Each member remains solely responsible for independently establishing their own rates and business terms.

11. Intellectual Property

Creator Backchannel's software, design, branding, logos, interfaces, databases, and other proprietary materials are owned by Creator Backchannel LLC or its licensors and are protected by applicable intellectual-property laws.

These Terms do not grant you ownership of Creator Backchannel LLC intellectual property.

12. Third-Party Information and No Professional Advice

Creator Backchannel contains information contributed by third parties.

We do not independently guarantee that community information is accurate, complete, current, or suitable for any particular purpose.

Creator Backchannel LLC does not provide legal, financial, tax, employment, or other professional advice.

You are responsible for evaluating information before relying upon it or using it to make professional or business decisions.

13. Suspension and Termination

We may suspend or terminate access for violations of these Terms, threats to the community or Service, fraudulent activity, loss of eligibility, or other legitimate reasons consistent with applicable law.

You may stop using Creator Backchannel at any time. Members may request account deletion through Settings or by emailing admin@creatorbackchannel.com. The treatment of account information and Contributions following deletion is described in our Privacy Policy.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CREATOR BACKCHANNEL LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY COMMUNITY-SUBMITTED INFORMATION WILL BE ACCURATE, COMPLETE, RELIABLE, OR CURRENT. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATOR BACKCHANNEL LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF CREATOR BACKCHANNEL LLC FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED U.S. DOLLARS ($100.00 USD), OR (B) THE TOTAL AMOUNT PAID BY YOU TO CREATOR BACKCHANNEL LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to defend, indemnify, and hold harmless Creator Backchannel LLC, its members, managers, officers, employees, contractors, and agents from and against any third-party claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your Contributions; (c) your breach or violation of these Terms or any applicable laws or regulations; (d) your violation of any third-party right, including intellectual property, confidentiality, or privacy rights; or (e) any misrepresentation made by you during verification.

17. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify members and require acceptance of the updated Terms before continued use of Creator Backchannel.

The Effective Date above identifies the current version.

18. Governing Law, Dispute Resolution, and Class Action Waiver

Governing Law: These Terms and any dispute or action arising out of or related to the Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles.

Informal Dispute Resolution: Before initiating formal legal proceedings, you agree to contact us at admin@creatorbackchannel.com and attempt to resolve the dispute informally.

Binding Arbitration: If a dispute cannot be resolved informally within thirty (30) days, both you and Creator Backchannel LLC agree that any claim or controversy arising out of or relating to these Terms or the Service will be settled by final and binding individual arbitration, administered in DuPage County, Illinois (or Chicago, Illinois) in accordance with the commercial rules of the American Arbitration Association (AAA).

CLASS ACTION WAIVER: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND CREATOR BACKCHANNEL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Exceptions & Forum: Either party retains the right to bring an individual action in small claims court or to seek emergency injunctive relief in a state or federal court of competent jurisdiction located in DuPage County, Illinois to prevent actual or threatened infringement or misappropriation of intellectual property rights.
